Role

The Mauritian National Contact Point for Responsible Business Conduct (NCP Mauritius):

promotes responsible business conduct under the OECD Guidelines for Multinational Enterprises on Responsible Business Conduct (OECD Guidelines) and the OECD due diligence guidance

contributes towards the resolution of complaints against multinational enterprises in relation to the implementation of the OECD Guidelines.

NCP Mauritius operates as a single unit under the Economic Development Board Act. As part of its functions, it is also responsible for advocating best practices on responsible business conduct as per the OECD Guidelines and assisting Government in formulating relevant national policies on responsible business conduct. Leveraging on a strong public-private collaboration, NCP Mauritius actively participates in various committees and forums to ensure policy coherence in this field.

The NCP Mauritius case handling mechanism promotes a collaborative approach ensuring that parties resolve issues in a timely and concerted manner. Participation in case handling is a voluntary process and mediation outcomes are not legally binding on the parties.

Structure & Operational Framework

Secretariat

The Secretariat of NCP Mauritius delivers administrative functions and represents Mauritius in international forums on responsible business conduct. The Secretariat is housed in the Economic Development Board.

Expert Panel

The expert panel comprises of experienced professionals from a wide range of disciplines designated to oversee complaints against multinational enterprises brought to the NCP Mauritius, including:

  • determination of cases;
  • communication and conciliation with parties
  • issuing statements on case-handling outcomes.

Advisory Panel

The Advisory Panel comprises of representatives from the Government, civil society, business associations and trade unions. Its function is to provide such recommendations to improve the overall strategy and administration of NCP Mauritius.

National Contact Points

The OECD Guidelines provide for a set of recommendations on Responsible Business Conduct (RBC) addressed by governments to multinational enterprises operating in or from adhering countries. They are supported by a unique implementation mechanism – the National Contact Points for Responsible Business Conduct (NCPs). Governments that adhere to the Guidelines are responsible for implementing and promoting them and commit to establish an NCP to further their effectiveness. RBC covers standards and recommendations to shape government policies and help businesses minimize adverse impacts across various issues such as corporate, social, environmental, labour or human rights abuses.

NCPs are not judicial bodies and provide for complaints handling mechanism promoting dialogue among parties (through ‘good offices’) in relation to the implementation of the OECD Guidelines by multinational enterprises.

As part of its functions, NCP Mauritius operates in accordance with the core principles of visibility, accessibility, transparency and accountability. Compliance with these principles ensure that NCP Mauritius operates in a systematic and effective approach, in accordance with international norms and good practices.
